This agreement is between the Ohio History Connection located at 800 East 17th Avenue, Columbus, Ohio, 43211 (“OHC”), and the Subscriber. The individual providing payment for this subscription acknowledges themselves as the Subscriber. 
1. OHC will provide teacher login access for all paid accounts that will remain active for the duration of the agreement. Teacher login accounts will be provided upon receipt of this signed agreement, teacher names and email addresses, and full payment. Upon logging in, teachers will be able to create student logins. Student logins will not be created by OHC. Creation of user credentials for students, teachers, and administrators is the responsibility of the Subscriber. Any use of personal information such as name, email address or other sensitive information by the Subscriber in that process is not the responsibility of OHC. 
2. All instructional materials, images, primary sources, and videos are owned by OHC, and except for the license expressly granted herein, Subscriber shall have no interest in these materials. OHC grants to subscriber a non-exclusive, royalty free license to use OHC materials for the purpose of student instruction for the duration of the agreement and for no other purpose. 
3. The terms of this agreement shall commence upon receipt of payment and shall be from one calendar year or term of higher education class from date of login creation. 
4. In the event this Agreement is cancelled by Subscriber or for any other cause beyond the control of OHC before the expiration date stated above, no refund of the amount paid for the subscription shall be made. In the event OHC cancels this agreement before the expiration date stated above, OHC shall refund to Subscriber a percentage of the amount paid based on the percentage of the term of the agreement remaining at the time of the cancellation. 
5. This Agreement sets forth the entire understanding between the Parties and supersedes all prior agreements, whether oral or written. This Agreement may not be modified or amended except by the mutual written agreement of the Parties. No waiver of any provision of the Agreement shall be effective unless it is in writing and signed by the party against whom it is sought to be enforced. 
6. This Agreement shall be interpreted in accordance with the laws of the State of Ohio.
